Important: Enforcement fees have changed

The new Taking Control of Goods (Miscellaneous Amendments) Regulations 2026 came into effect on 1 May 2026. 

The regulations bring key changes affecting enforcement notice periods and fee structure. The new Regulations apply to all cases received by an Enforcement Agency on or after 1 May 2026. 

 

Key regulatory changes: 

1. Notice of Enforcement - extended notice period 

The minimum notice period provided before enforcement action will take place has increased from: 

  • 7 days to 14 days  

 

2. Fee application 

Cases received on or after 1 May 2026 

  • Compliance Stage (initial contact): £79  

  • Enforcement Stage (Enforcement Agent visit): £247 + 7.5% on the portion of the debt exceeding £1,900  

  • Sale/Disposal Stage (if goods are removed and sold): £116 + 7.5% on the portion of the debt exceeding £1,900  

For cases received before 1 May 2026, the 2014 fee structure and notice periods will still apply as below:

Notice of Enforcement – 7 days 

Fee Structure:  

  • Compliance Stage (initial contact): £75  

  • Enforcement Stage (Enforcement Agent visit): £235 + 7.5% on the portion of the debt exceeding £1,500  

  • Sale/Disposal Stage (if goods are removed and sold): £110 + 7.5% on the portion of the debt exceeding £1,500 

Debt advice

If required, a recognised debt adviser may contact us on your behalf to request additional time for you to obtain advice. To ensure this can be considered, they must contact us promptly at: debtadvice@dukeslimited.co.uk 

Where a valid request is received, we will consider extending the compliance period to up to 28 days in accordance with the Taking Control of Goods (Miscellaneous Amendments) Regulations 2026 prior to taking further enforcement action.
